PeakHerd provides an application for managing goat and sheep livestock records, including inventory, health, breeding, and usage tracking (the “Content”), available worldwide via web, smartphone, or computer. To access certain features, you must create an account with accurate information and maintain secure credentials. You are responsible for all activity under your account and must notify us immediately of any unauthorized use. Accounts may include free, Basic, Premium, and Enterprise tiers with recurring billing via Stripe. Subscriptions auto-renew unless canceled; we may adjust fees with notice.
You warrant that you own or license any Content uploaded and that it does not infringe third-party rights, violate laws, or contain harmful elements like viruses. You must implement security measures (e.g., backups).
You agree to indemnify, defend, and hold harmless PEAKHERD TECHNOLOGIES, INC., its affiliates, officers, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to: (a) your violation of these Terms; (b) your use of the Service; (c) your violation of any rights of another, including intellectual property rights; or (d) your Content.
By uploading or submitting Content to the Service, you grant PEAKHERD TECHNOLOGIES, INC. a non-exclusive, worldwide, royalty-free, transferable, and sub-licensable license to use, reproduce, modify, adapt, publish, and display such Content solely for the purpose of operating, providing, and improving the Service. You retain all ownership rights in your Content, subject to the rights granted herein. You may revoke this license by removing your Content from the Service, except to the extent it has been shared with others or incorporated into the Service.

The Service is provided “as is” and “as available,” without any express or implied warranties, including but not limited to merchantability, fitness for a particular purpose, or non-infringement. While we strive to maintain the security and availability of the Service, we do not warrant that the Service will be uninterrupted, error-free, or free from harmful components.
To the maximum extent permitted by applicable law, PEAKHERD TECHNOLOGIES, INC. and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, arising from your use of or inability to use the Service, even if we have been advised of the possibility of such damages. Our total liability to you for any claims arising from or related to the Service shall not exceed the amount of fees you paid to us for the Service in the twelve (12) months preceding the event giving rise to the claim.
We may terminate or suspend your access for breach of these Terms. You may cancel anytime; cancellations take effect at billing period end, without refund for current period.
These Terms are governed by the laws of Texas, USA. Any dispute, claim, or controversy arising out of or relating to these Terms or your use of the Service shall first be attempted to be resolved informally by contacting support@peakherds.com. If not resolved within thirty (30) days, the parties agree to attempt to resolve the dispute through mediation administered by the American Arbitration Association. If mediation is unsuccessful, the dispute shall be subject to the exclusive jurisdiction of the state and federal courts located in Texas, USA.
New paid subscribers get a 14-day money-back guarantee. Contact support@peakherds.com with details. Refunds are available only to new paid subscribers who request a refund within fourteen (14) days of initial purchase. Refunds are not available for subscription renewals, accounts found to be in violation of these Terms, or accounts that have engaged in fraudulent or abusive activity. All refund requests must be submitted to support@peakherds.com with relevant details. PEAKHERD TECHNOLOGIES, INC. reserves the right to deny refund requests that do not meet these criteria.
We may modify these Terms at any time. For material changes, we will provide at least thirty (30) days’ advance notice by email to the address associated with your account and/or by posting a notice on our website. Your continued use of the Service after the effective date of any changes constitutes your acceptance of the revised Terms.
